Proposed law on special funds: the Constitutional Council agrees with the Government

The sentence has fallen. The seven Wise Men of the Constitutional Council declared, this Tuesday, inadmissible the proposed law relating to the legal regime of special credits. A decision which puts an end to the standoff between the Government and the National Assembly around this text. The National Assembly had included several texts, including this bill, on the agenda for its first extraordinary session of 2026, according to the emergency procedure. This was adopted in committee and was to be examined in plenary session on Wednesday August 19, 2026.

But before its examination in plenary, the Government had raised an objection of inadmissibility. In a press release, the Executive considered that certain provisions of the proposed law fell within the domain reserved for regulatory power, in accordance with articles 67 and 76 of the Constitution. Faced with this divergence, the Government decided to refer the matter to the Constitutional Council, in accordance with the provisions of Article 83, paragraph 2, of the Constitution, taken up by Article 69, paragraph 8, of Organic Law No. 2025-11 of August 18, 2025 establishing the Internal Regulations of the National Assembly.

In its referral, the Government asked the Wise Men to declare the bill inadmissible. The Constitutional Council finally ruled in favor of the Executive. By declaring the text inadmissible, the seven Sages thus confirm the position defended by the Government.
