CHISHIMBA Kambwili tampered with evidence in a case that was already in court, a witness has testified.
Testifying in a matter where Kambwili has been cited for contempt of court, Chilufya Tayali yesterday told Lusaka Magistrate Nsunge Chanda that he complained against the Roan member of Parliament because he chaired the meeting that resolved to change particulars of Mwamona Engineering and Technical Services directors.
Mr. Tayali said after he testified in a case where Kambwili has been charged for forgery, uttering a false document, and giving false information to a public officer before Principal Resident Magistrate Simusamba earlier this year, the arresting officer informed him that the accused person had lodged in documents at Patents and Companies Registration Agency (PACRA) to change the directors’ particulars.
“I got concerned because my testimony in court in the morning before Magistrate Simusamba was basically on the directorship of Mwamona…I asked the police officer to confirm what the caller from PACRA had told him.
He said the officer confirmed that the directors’ names had been changed, with one of them changing from Mwamba Chishimba on the initial Form 71 during incorporation of the company in 2001, to Mwamba Kambwili and that the latter’s national registration card number had also changed.
“These alterations confirmed the concern I had the day before. I was worried that the testimony I had given was not consistent with the updated records at PACRA. I basically complained by swearing in an affidavit because I felt fundamentals of the case I had earlier complained on and testified in had significantly changed.
“The complaint I made was based on the names of the directors, particularly one director Mwamba Chishimba. This Mwamba Chishimba is the son of the accused but I knew that the son of the accused was not Mwamba Chishimba but Mwamba Kambwili,” he said.
